Technology Center 1600 handles applications in the life sciences technology sector, including applications touching on microbiology, immunology, cosmetics, and drugs. TC 1600 also handles plant patent applications. Of all technology centers at the USPTO, TC 1600 is the most difficult in which to obtain a patent, given that its overall allowance rate of 63% is well below the USPTO average of 72%. Thus, applicants desiring a patent in the life sciences field, in addition to dealing with Mayo and Myriad rejections, also face an uphill climb due to the tech center’s low allowance rate. Below, we’ll pull back the curtain on several prosecution trends that have occurred in TC 1600 during the five-year period between 2013 and 2017. Please note that all metrics herein are based on published applications only and do not account for all applications filed after the USPTO's 18-month publication delay period (in this case, January 2016).
